Judge Denies EA’s Request To Throw Out Activision Lawsuit

A US superior court judge has turned down EA’s request to throw out Activision’s contract-meddling suit of $400 million which relates to the departure of former Infinity Ward bosses: Jason West and Vince Zampella.

Judge Elihu Berle ruled that Activision had demonstrated enough evidence to uphold its claim and ordered the case move on to trial on May 7th, 2012. A similar motion was put up by West and Zampella but was also turned down.

Activision maintains West and Zampella breached their contracts and duties of loyalty with “insubordinate” actions, adding that the behavior was caused at least in part by EA’s “unlawful tampering”.

West and Zampella have since then formed Respawn Entertainment, teasing its new IP with blurry images, all founded by EA.

    no, seriously i really cant wait for this to start im really interested to see what happened.
    not that we probably ever will, those details will probably stay in the court but the ways things have been leaking lately………

    I actually think Activision stands a better chance here. More and more it’s beginning to look like West and Zampella were in the wrong, sleeping in bed with EA and all….Especially now that their new studio totally founded by EA..

    hard to say we dont know any details yet.
    there claiming they were owed loyalties and overtime heaps of unpaid salarys so if thats true fair game as far as im concerned.
    if your on contract and am not getting paid what your entitled to id sure as hell be looking elsewhere!
    eh, only time will tell.
