Judge: Xbox 360 Should Be Banned In U.S.

The battle between Microsoft and Motorola has gone to a whole new level and President Obama might need to step in to resolve the situation.

Courthouse News reports that Judge David Shaw said the International Trade Commission should use a cease and desist order to ban imports of the Xbox 360 Slim 4GB and 250GB models into the US because, as he sees it, they infringe on four patents owned by Motorola.

Judge Shaw also wants Microsoft to post a bond equal to seven per cent of the value of unsold Xbox 360s in the US.

Microsoft fought back with a response, claiming the decision would not serve the U.S. public fairly as it would leave only two consoles on the market available to consumers: PlayStation 3 and Nintendo Wii. The judge didn’t buy Microsoft’s argument, however, saying it was more important to enforce intellectual property rights. Plus, he wasn’t convinced Sony and Nintendo wouldn’t be able to meet increased demand.

Microsoft said the suggested seven percent bond was unjustified, and recommended it be reduced to 2.5 per cent. Motorola sees things differently, pushing for an increase of, wait for it, 100 percent of the value of the unsold Xbox 360s.

So, how do we proceed? Well, if the ITC makes the judge’s recommendation final, President Barack Obama will then have 60 days to review the decision. After that period ends, the next step is the Court of Appeals for the Federal Circuit.

    its ok for M$ to infringe on others patients, but if it was someone else infringing on their patents would they be singing the same tune to the same verdict?
    i think not!
    as for motorolla there just greedy, the judge sides with them so they say no thats not enough we want more!

    what happened to the good old days when someone gave you something and you said thank you and walked away?
    not spat in their face and said i want more!
