it could work really well with the kinect, they just dont want to dive into the minefield of angry fans when it does not work!
look how skyrim does it, lean in a particular direction to move in that direction, hold your arm out as your reticule and close to a fist when you want to fire.

theres heaps of mods online of people modding kinect to work with shooters, hell theres even ones with people modding it to work with the ps3 and killzone 3!
this apparently has a feb launch date too, surprised actually allot earlier than what i expected!
