Following a ruling in the favor of Modern Warfare creators Jason West and Vincent Zampella, the duo’s case against Activision is now likely to go to trial.
Per The Hollywood Reporter, a Los Angeles Superior Court judge has deemed that there is sufficient evidence to support allegations that Activision held back over $125 million from the two men, firing them right before it was time to pay up.
“Instead of thanking, lauding, or just plain paying Jason and Vince for giving Activision the most successful entertainment product ever offered to the public,” attorney representing the two men, Robert Schwartz said in March of 2010, “last month Activision hired lawyers to conduct a pretextual ‘investigation’ into unstated and unsubstantiated charges of ‘insubordination’ and ‘breach of fiduciary duty,’ which then became the grounds for their termination on Monday, March 1st.”
Wasting no time, Activision filed a suit of its own, accusing that the co-founders of Infinity Ward were “insubordinate and self-serving schemers who attempted to hijack Activision’s assets for their own personal gain.”
The mega-publisher didn’t stop there, however, dragging EA into the fight, accusing the firm of trying to lure West and Zampella while they were yet under contract. $400 million of damages is what Activision’s demanding.
If court settlements are not reached, you should expect a showdown late 2011 into early 2012.
i doubt there will be a settlement theres to much spite between the parties.
